www.peaceapp.ai (“Website”) on the world wide web as well as the software and applications provided by Peace App, including but not limited to the mobile application(s), Mobile Website, the other associated/ancillary applications, products, websites and services managed by Peace App (together with the Website, referred to as the “Peace App Platform”).
This privacy policy ("Privacy Policy") explains how we collect, use, share, disclose and protect Personal Information about the Users of the Peace App Platform, including the Practitioners (as defined in the Terms of Use, which may be accessed at Terms of Use), the End-Users (as defined in the Terms of Use), and the visitors of Website (jointly and severally referred to as “You” or “Users” in this Privacy Policy). We created this Privacy Policy to demonstrate our commitment to the protection of your privacy and your personal information. Your use of and access to the Peace App Platform is subject to this Privacy Policy and our Terms of Use. Any capitalized term used but not defined in this Privacy Policy shall have the meaning attributed to it in our Terms of Use.
1. Why This Privacy Policy?
This Privacy Policy is published in compliance with, inter alia:
- Section 43A of the Information Technology Act, 2000.
- Regulation 4 of the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Information) Rules, 2011 (the “SPI Rules”).
- Regulation 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011.
This Privacy Policy states the following:
- The type of information collected from the Users, including Personal Information and Sensitive Personal Data or Information relating to an individual.
- The purpose, means and modes of collection, usage, processing, retention, and destruction of such information; and
- How and to whom Peace App will disclose such information.
2. Collection of Personal Information
Generally, some of the functions on the Peace App Platform require us to know who you are so that we can best meet your needs. When you access the Peace App Platform, or through any interaction with us via emails, telephone calls or other correspondence, we may ask you to voluntarily provide us with certain information that personally identifies you or could be used to personally identify you. You hereby consent to the collection of such information by Peace App. Without prejudice to the generality of the above, information collected by us from you may include (but is not limited to) the following:
- contact data (such as your email address and phone number).
- demographic data (such as your gender, your date of birth and your pin code).
- data regarding your usage of the Peace App Platform and history of the appointments made by or with you through the use of Peace App Platform.
- insurance data (such as your insurance carrier and insurance plan).
- other information that you voluntarily choose to provide to us (such as information shared by you with us through emails or letters or uploaded on the platform in connection with the Peace App Platform).
The information collected from you by Peace App may constitute ‘personal information’ or ‘Sensitive Personal Data or Information’ under the SPI Rules.
- “Personal Information” is defined under the SPI Rules to mean any information that relates to a natural person, which, either directly or indirectly, in combination with other information available or likely to be available to a body corporate, is capable of identifying such person.
- “Sensitive Personal Data or Information” is defined under the SPI Rules to mean personal information about that person relating to: passwords; financial information such as bank accounts, credit and debit card details or other payment instrument details; physical, physiological, and mental health condition; sexual orientation; medical records and history; biometric information; information received by body corporate under lawful contract or otherwise; visitor details as provided at the time of registration or thereafter; call data records; and photos (optional, uploaded by users in order to use certain features).
Health data (iOS HealthKit / Google Fit). When you share your iOS Health app data or Google Fit with our app, that data is covered by this privacy policy. We handle all iOS Health app and HealthKit data in accordance with Apple's development guidelines. Our App cannot write data to HealthKit. You can remove Apple HealthKit read access to Peace App at any time inside the Apple Health app. We handle Google Fit data in accordance with Google Fit Terms of Service. HealthKit, Health app, iPhone, and Apple are registered trademarks of Apple Inc. Google Fit and Google are registered trademarks of Google Inc. If you wish to change any of our access or permissions, you may do so in your device's settings. However, revoking these permissions may prevent you from using all or some of the functionality of our services.
Peace App will be free to use, collect and disclose information that is freely available in the public domain without your consent.
Nature of Data Processing
- Data Collection: Data is collected via secure online forms, teletherapy session registrations, and patient feedback surveys.
- Data Usage: Collected data (e.g., patient identifiers, mental health histories, session notes, and treatment feedback, name, phone number) is used to schedule sessions, deliver personalized therapy, generate anonymized analytics for service improvement and sharing comms.
- Data Storage & Deletion: All data is stored on encrypted servers hosted in India, US, UK (depending on user location) and backed up in a secure cloud environment. Data is retained only as long as needed for treatment and regulatory compliance.
- Data Sharing: Data is shared only with in-house professionals (therapists, data analysts) which the user is aware, as their consent is sought after.
3. Privacy Statements
3.1 Users note: this section applies to all Users.
- A condition of each User's use of and access to the Peace App Platform is their acceptance of the Terms of Use, which also involves acceptance of the terms of this Privacy Policy. Any User that does not agree with any provisions of the same has the option to discontinue the use of the Peace App Platform provided by Peace App immediately.
- An indicative list of information that Peace App may require you to provide to enable your use of the Peace App Platform is provided in the Schedule annexed to this Privacy Policy.
- All the information provided to Peace App by a User, including Personal Information or any Sensitive Personal Data or Information, is voluntary. Peace App may use such information for: providing you the access of Peace App Platform; communication purposes so as to provide You a better way of booking appointments and for obtaining feedback in relation to the Practitioners and their practice; debugging customer support related issues; and for the purpose of contacting you to complete any transaction if you do not complete a transaction after having provided us with your contact information.
- Peace App also reserves the right to use the information provided by or about the End-User for the following purposes: publishing such information on the Website; contacting End-Users for offering new products or features; contacting End-Users for taking product and Service feedback; analysing software usage patterns for improving product design and utility; analysing anonymized practice information for commercial use; and processing payment instructions, including those through independent third-party service providers such as payment gateways, banking and financial institutions, pre-paid instrument and wallet providers.
- If you have voluntarily provided your Personal Information to Peace App for any of the purposes stated above, you hereby consent to such collection and use of such information by Peace App. Furthermore, by providing us with the Personal Information you authorize Peace App (including its business partners and affiliates) to contact You on Your telephone number(s) and email for any purpose, even if you have registered yourself under DND or DNC or NCPR services.
- We do not control or endorse the content, messages or information found on the Peace App Platform and Peace App specifically disclaims any liability with regard to the services and any actions resulting from your participation in any services.
- You are responsible for maintaining the accuracy of the information you submit to us. You may correct, delete inaccuracies, or amend information by contacting us through hello@Peaceapp.ai.
- If you wish to cancel your account or request that we no longer use your information, contact us through hello@Peaceapp.ai. We will retain your information for as long as your account is active and as needed to provide you access to the Peace App Platform.
- If you wish to opt-out of receiving non-essential communications such as promotional and marketing-related information, please send us an email at hello@Peaceapp.ai.
- The Website uses temporary cookies to store certain (non-sensitive) data used for the technical administration of the Website, research and development, and User administration. You may adjust your Internet browser to disable cookies.
3.2 Practitioners note: this section applies to all Practitioners.
As part of the registration and application creation and submission process available to Practitioners, certain information, including Personal Information or Sensitive Personal Data or Information, is collected from the Practitioners. All the statements in this Privacy Policy apply to all Practitioners. Peace App reserves the right to use the information provided by or about the Practitioner for publishing on the Website, contacting for new products, taking product feedback, analysing usage patterns and anonymized practice information.
3.3 End-Users note: this section applies to all End-Users.
As part of the registration/application creation and submission process available to End-Users, certain information is collected. Peace App reserves the right to use anonymized End-User demographics and anonymized End-User health information for analysing usage patterns, research and development of new technologies, and other commercial product offerings. Peace App will communicate with End-Users through email, phone and notices posted on the Website. All Peace App employees and data processors who have access to, and are associated with the processing of Sensitive Personal Data or Information are obliged to respect the confidentiality of every End-User's Personal Information.
3.4 Casual Visitors note.
No sensitive personal data or information is automatically collected by Peace App from casual visitors who are merely perusing the Website. You are not a casual visitor if you have willingly submitted any personal data through any means, in which case you will be treated as a User.
4. Confidentiality and Security
- Your Personal Information is maintained by Peace App in electronic form on its equipment, and on the equipment of its employees. Peace App takes all necessary precautions to protect your personal information both online and off-line, and implements reasonable security practices and measures including managerial, technical, operational and physical security control measures.
- No administrator at Peace App will have knowledge of your password. It is important for you to protect against unauthorized access to your password, your computer, and your mobile phone. If you suspect any unauthorized use of your account, you must immediately notify Peace App at hello@Peaceapp.ai.
- Peace App makes all User information accessible to its employees, agents or partners and third parties only on a need-to-know basis, and binds only its employees to strict confidentiality obligations.
- Notwithstanding the above, Peace App is not responsible for the confidentiality, security or distribution of your Personal Information by our partners and third parties outside the scope of our agreement with such partners and third parties. Further, Peace App shall not be responsible for any breach of security or for any actions of any third parties or events that are beyond the reasonable control of Peace App.
5. Change to Privacy Policy
Peace App may update this Privacy Policy at any time, with or without advance notice. In the event there are significant changes in the way Peace App treats User's personally identifiable information, or in the Privacy Policy itself, Peace App will display a notice on the Website or send Users an email. If a User uses the Peace App Platform or accesses the Website after a notice of changes has been sent or published, such User hereby provides his/her/its consent to the changed terms.
6. Children's and Minor's Privacy
Peace App strongly encourages parents and guardians to supervise the online activities of their minor children. Although the Peace App Website and Peace App Platform are not intended for use by minors, Peace App respects the privacy of minors who may inadvertently use the internet or the mobile application.
7. Consent to This Policy
You acknowledge that this Privacy Policy is a part of the Terms of Use of the Website and the Peace App Platform, and you unconditionally agree that becoming a User of the Website and the Peace App Platform signifies your (i) assent to this Privacy Policy, and (ii) consent to Peace App using, collecting, processing and/or disclosing your Personal Information in the manner and for the purposes set out in this Privacy Policy.
8. Address for Privacy Questions
Should you have questions about this Privacy Policy or Peace App's information collection, use and disclosure practices, you may contact the Grievance Officer appointed by Peace App in accordance with the provisions of the Information Technology Act, 2000 and Rule 3(11) of the Information Technology (Intermediaries guidelines) Rules, 2011.
9. Schedule — Indicative List of Information by Nature of Service
- End-Users registering for an account: You can create an account by giving us information regarding your name, mobile number, email address, and such other information as requested. This enables us to provide you with the facility to use the account to book your appointments and store other health-related information.
- End-Users using the Website without registering (Guest): You can use the Website (with limited functionality) without registering, but to book an appointment you may be asked to create an account and/or provide certain information (including your mobile number, email).
- Practitioner listing: As a Practitioner, you may be required to provide information regarding your name, mobile number, email address, and such other information as requested on the Practitioner registration page.
- Practitioners using Peace App products: You will be required to create an account and provide information regarding your name, mobile number, email address, and other information. Upon registration, Peace App will access your customer/client information and their medical records. You agree to make your customer/client fully aware of such access.
